1. About bite.je
bite.je provides technology that connects customers with independent restaurants and delivery providers in Jersey, Channel Islands. The restaurant, not bite.je, sells and prepares the food and accepts the customer's order. bite.je acts as an ordering and limited payment intermediary. By using the platform, you agree to these terms and any customer or partner terms that apply to your role.
2. Ordering
- Orders are placed with the restaurant, not with bite.je. We act as an intermediary.
- All prices displayed are GST-inclusive (Jersey GST at 5%).
- Menu items, prices, and availability are set by the restaurant and may change.
- Allergen information is provided by each restaurant and displayed on every menu item. If you have a specific allergy, contact the restaurant directly to confirm before ordering — their phone number is listed on their menu page.
3. Payment
- Payments are processed securely by the payment provider shown at checkout. We never see or store your full card number.
- Payment is taken at the time of ordering.
- We treat an order as paid only after the payment provider confirms success. If a payment attempt fails or expires, use the existing checkout or the recovery option shown for that order; do not submit repeated payments while its status is uncertain.
- If you believe you were charged twice, contact us promptly with the order number and the dates and amounts shown by your bank. Do not send card numbers or security codes.
- All amounts are in British Pounds Sterling (GBP).
4. Delivery & Collection
- Delivery times are estimates provided by the restaurant.
- Delivery is available to addresses within Jersey only.
- Collection orders should be picked up at the time indicated.
5. Cancellations & Refunds
- Orders may be cancelled before the restaurant confirms them.
- Once confirmed, cancellation is at the restaurant's discretion.
- Refund requests should be directed to the restaurant via our platform.
- If an order is not fulfilled, we will assist in arranging a refund.
- A partial refund adjusts only the agreed part of the payment. A full refund reverses the affected payment once the provider confirms it, but does not by itself rewrite whether the order was prepared, delivered or cancelled. Provider and bank processing times may apply after a refund is accepted.
- The statutory distance-selling cancellation provisions do not apply to contracts for the supply of food or beverages. This does not affect your rights where food or a service is faulty, misdescribed, unsafe, or otherwise fails to meet rights that cannot lawfully be excluded.
6. Your Account
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account.
- You may request account deletion at any time from your account settings.
7. Liability
bite.je is not responsible for acts or omissions outside our control, including the preparation, quality, safety, temperature, description, allergen content or legal compliance of food supplied by a restaurant; a restaurant's refusal or failure to fulfil an order; or the acts, omissions and timing of an independent delivery provider.
Where bite.je is responsible for a platform failure, our liability for direct loss arising from that failure is capped up to the value of the affected order and our aggregate liability to one customer for platform failures in any 12-month period is capped up to £100. We are not liable for indirect or consequential loss, loss of profit, revenue, business opportunity or goodwill, except where such liability cannot lawfully be excluded.
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any statutory consumer right or other liability that cannot be excluded or limited under Jersey law.
8. Age-Restricted Products
- Some restaurants on bite.je sell alcohol and other age-restricted products. By placing an order containing such items, you confirm that you are aged 18 or over.
- Responsibility for compliance with the Licensing (Jersey) Law 1974 — including age verification at the point of sale and delivery — rests with the restaurant, not with bite.je. The restaurant or delivery driver may request proof of age before handing over an order. If you cannot provide acceptable proof, the order may be refused without refund.
- It is an offence to purchase alcohol for someone under the age of 18. bite.je reserves the right to cancel any order where we reasonably suspect that alcohol is being purchased for a minor, but we do not accept responsibility for age verification failures by a restaurant or its delivery drivers.
9. Governing Law
These terms are governed by the laws of Jersey, Channel Islands. Any disputes shall be subject to the exclusive jurisdiction of the Royal Court of Jersey.
